This Privacy Policy describes how Maintly LLC, a Florida limited liability company ("Maintly," "we," "us," or "our"), collects, uses, and discloses information when you use our website, mobile application, and related services (collectively, the "Service"). This Policy applies to homeowners, property owners, business and investor users, contractors, and any other person who interacts with the Service.

By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree with this Policy, you must not use the Service.

1. Information We Collect

1.1 Information You Provide Directly

We collect information you provide when you create an account, set up your profile, manage properties, request services, or otherwise interact with the Service. This includes:

Account Information. Name, email address, password, phone number, profile photo, and authentication credentials (including via third-party sign-in providers).

Account Type Information. Whether you are signing up as a homeowner, business or investor, or contractor, and any entity information you provide (such as LLC name, trust name, or other business entity designation).

Property Information. Property addresses, property characteristics (such as square footage, age, systems present), property photos, access instructions, and any notes you provide about a property.

Service Information. Details about maintenance services you set up, schedule, or receive, including service type (DIY, My Contractor, or Maintly Managed), service frequency, contractor assigned, visit dates, visit logs, and any photos or notes related to a visit.

Payment and Financial Information. When you fund your credit wallet, purchase services, or receive payouts, we collect billing information necessary to process the transaction. Payment card details are collected and processed by our payment processor (Stripe) and are not stored on Maintly's servers. We retain transaction records (amount, date, description, and reference identifiers) for accounting and compliance purposes.

Contractor Information. If you sign up as a contractor, we additionally collect business name, business address, service categories, service area, licensing and insurance documentation, identification documents, tax information (such as W-9), payout account information (collected by Stripe Connect), and credentials submitted for tier verification.

Communications. Messages you send through the Service, support requests, complaint submissions, and any other communications you have with Maintly or with other users through the platform.

1.2 Information Collected Automatically

When you use the Service, we automatically collect certain information about your device and how you interact with the Service:

Device and Usage Data. IP address, browser type and version, device type, operating system, language preferences, referring URLs, pages visited, features used, time and date of access, and time spent on each page.

Location Data. With your permission, we may collect approximate or precise location data from your device. Contractors using the route management features will have location accessed when actively logging visits or navigating routes. You can disable location services at any time through your device settings, though doing so may limit certain features.

Cookies and Similar Technologies. We use cookies, web beacons, and similar tracking technologies to operate the Service, remember your preferences, analyze usage, and improve performance. You can manage cookie preferences through your browser settings.

Analytics Data. We use product analytics tools to understand how users interact with the Service, including which features are used, where users encounter friction, and how the platform performs.

1.3 Information from Third Parties

Property Data Providers. We may obtain property characteristics and ownership information from third-party data providers to enrich property records.

Authentication Providers. If you sign in using a third-party authentication service, we receive basic profile information from that provider as authorized by you.

Payment Processors. Our payment processor provides us with information needed to confirm transactions, manage payouts, and verify identity.

Other Users. Information about you may be provided by other users — for example, when a contractor invites you to the platform, or when a homeowner adds your contact information when inviting you to be their service provider.

2. How We Use Information

We use the information we collect for the following purposes:

To Provide the Service. Operate your account, manage properties, schedule and track services, process payments and payouts, send notifications, and deliver the features you request.

To Communicate With You. Send transactional messages (such as visit confirmations, payment receipts, payout notifications, and service updates), respond to inquiries, and provide customer support.

To Send Marketing Communications. Send promotional emails about new features, updates, and offers. You can opt out of marketing emails at any time using the unsubscribe link in those messages or by adjusting your notification preferences. We will not send marketing text messages without your express prior consent.

To Improve the Service. Analyze usage patterns, diagnose technical issues, develop new features, and improve existing ones. This may include using anonymized or aggregated data to train and improve models that power scheduling, recommendations, and other platform features.

For Safety and Security. Verify identities, prevent fraud, detect and prevent abuse, enforce our Terms of Service, and protect the rights, property, and safety of users and the public.

For Legal and Compliance Purposes. Comply with legal obligations, respond to lawful requests from authorities, enforce agreements, and protect against legal claims.

For Business Operations. Conduct accounting, audits, business planning, and other internal operations.

3. How We Share Information

Maintly does not sell your personal information. We share information only as described below.

3.1 With Other Users on the Platform

Homeowner-Contractor Sharing. When a homeowner sets up a service with a contractor, the homeowner's name, property address, contact information, service details, and access instructions are shared with that contractor as needed to perform the service. When a contractor logs a visit, the contractor's name, business name, visit notes, and photos are shared with the homeowner of that property.

Property Handoff. When a property changes ownership through the Service, the new owner of that property will receive limited summary information about the property's prior maintenance history, including service types performed and dates of service. Visit photos, contractor communications, complaint records, and other detailed records from the prior owner are not transferred to the new owner. The departing owner may request a one-time export of their full property records within thirty (30) days of the handoff.

3.2 With Service Providers

We share information with third-party service providers who perform services on our behalf, subject to confidentiality and data protection obligations. These categories of service providers include:

  • Payment processors (for processing credit top-ups and contractor payouts)
  • Cloud hosting and infrastructure providers (for storing data and operating the Service)
  • Email and SMS providers (for delivering transactional and marketing communications)
  • Analytics and product monitoring providers (for understanding usage and diagnosing issues)
  • File storage and upload providers (for handling visit photos and document uploads)
  • Property data providers (for enriching property records)
  • Customer support tools (for responding to inquiries)
  • Identity verification and fraud prevention providers (for verifying contractor credentials and protecting the platform)

3.3 With Legal and Regulatory Authorities

We may disclose information when we believe in good faith that disclosure is necessary to:

  • Comply with applicable law, regulation, legal process, or governmental request
  • Enforce our Terms of Service or other agreements
  • Protect the rights, property, or safety of Maintly, our users, or others
  • Detect, prevent, or address fraud, security, or technical issues
  • Respond to claims that any content violates the rights of third parties

3.4 In Connection with a Business Transaction

If Maintly is involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, your information may be transferred as part of that transaction. We will provide notice before your information is transferred and becomes subject to a different privacy policy.

3.5 Aggregated and De-Identified Data

We may use and share aggregated or de-identified information that cannot reasonably be used to identify you for any purpose, including for analytics, research, marketing, and service improvement.

3.6 With Your Consent

We may share information for any other purpose disclosed to you and with your consent.

4. The Property as Permanent Record

Maintly is built around the principle that maintenance history belongs to the property, not solely to the person who currently owns it. This affects how we treat data:

Property Records Persist. Service history, visit logs, contractor records, and other records associated with a property remain attached to the property record over time. When ownership changes, the property record continues; only the visible scope of the record changes (as described in Section 3.1).

Account Deletion. When you delete your account, we will delete or de-identify your personal information (name, contact details, payment information, and other identifying data) in accordance with applicable law. Property and service records associated with properties you owned will remain attached to the property record in de-identified form, so that the property's maintenance history persists for the benefit of the property and any future owner. Records that we are required by law or legitimate business purposes to retain (including financial records, tax records, contractor business records, and dispute records) will be retained for as long as necessary for those purposes.

Contractor Records. Records of services a contractor performed are part of the contractor's own business records. These records will be retained even if a homeowner deletes their account, so that contractors retain documentation of work performed and payments received.

5. Data Retention

We retain personal information for as long as your account is active or as needed to provide the Service. We may retain certain information after your account is closed for the following purposes:

  • Financial and tax records: Retained for at least seven (7) years to comply with tax, accounting, and audit obligations
  • Property maintenance records: Retained for the lifetime of the property record (de-identified after account deletion as described in Section 4)
  • Dispute and complaint records: Retained for as long as necessary to resolve the dispute and for any applicable limitations period
  • Legal and compliance records: Retained as required by applicable law

When information is no longer needed for these purposes, we delete it or de-identify it.

6. Data Security

We implement reasonable administrative, technical, and physical safeguards designed to protect your information against unauthorized access, disclosure, alteration, and destruction. These include:

  • Encryption of data in transit (TLS) and at rest where appropriate
  • Role-based access controls and per-user data scoping at the database layer
  • PCI-compliant payment infrastructure for processing card data
  • Regular security reviews and monitoring
  • Limited employee access to personal information on a need-to-know basis

No system is perfectly secure. If you believe your account has been compromised, please contact us immediately at security@maintly.io.

In the event of a data breach affecting your personal information, we will notify you in accordance with applicable breach notification law.

7. Your Privacy Rights

7.1 General Rights

Depending on your location, you may have the following rights regarding your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request that we correct inaccurate or incomplete information
  • Deletion: Request deletion of your personal information, subject to the limitations described in Section 4 and Section 5
  • Portability: Request a copy of certain information in a portable format
  • Objection and Restriction: Object to or request restriction of certain processing activities
  • Withdraw Consent: Withdraw consent for processing that is based on consent (such as marketing communications)

7.2 California Residents (CCPA / CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act:

  • Right to Know. You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which the information was collected, the purposes for collecting the information, and the categories of third parties with whom we share the information.
  • Right to Delete. You may request that we delete personal information we have collected from you, subject to certain exceptions.
  • Right to Correct. You may request that we correct inaccurate personal information.
  • Right to Opt Out of Sale or Sharing. Maintly does not sell or share personal information for cross-context behavioral advertising as those terms are defined under the CCPA. If this changes, we will update this Policy and provide an opt-out mechanism.
  • Right to Limit Use of Sensitive Personal Information. Maintly does not use sensitive personal information for purposes beyond those expressly permitted by the CCPA without consent.
  • Right to Non-Discrimination. We will not discriminate against you for exercising any of these rights.

To exercise these rights, contact us at privacy@maintly.io. We will verify your identity before responding to certain requests. You may also designate an authorized agent to make a request on your behalf.

7.3 Florida Residents

Florida residents have rights under applicable Florida law with respect to security of personal information and breach notification. We will notify Florida residents of any breach of security that compromises personal information in accordance with Florida law.

7.4 Users Outside the United States

The Service is operated in the United States. If you access the Service from outside the United States, your information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country. By using the Service, you consent to this transfer.

If you are located in a jurisdiction that grants additional rights with respect to personal information (such as the European Economic Area, the United Kingdom, or other regions with comprehensive privacy laws), you may have additional rights including the right to lodge a complaint with your local data protection authority. 8. Children's Privacy

The Service is not directed to children under the age of 18, and we do not knowingly collect personal information from children under 18. If you believe a child has provided personal information to us, please contact us at privacy@maintly.io and we will take steps to delete the information.

9. Third-Party Links and Services

The Service may contain links to third-party websites or services. We are not responsible for the privacy practices of those third parties. We encourage you to review the privacy policies of any third-party service you visit or use.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email and/or through the Service, and update the "Last Updated" date at the top of this Policy. Continued use of the Service after the effective date of an updated Policy constitutes your acceptance of the changes.
